Frontline Asks FCC to Ban Verizon from Spectrum Auction - Reasonable request or just trying to eliminate the competition?

Verizon Wireless has drawn significant attention to itself regarding the FCC spectrum auction, lobbying the FCC to change the auction conditions while simultaneously suing the FCC outright in court over the same issue. Frontline, a startup wireless company competing against Verizon in the auction, wants the FCC to give Verizon more than just attention. The startup is asking the FCC to sanction Verizon by banning the company from the spectrum auction altogether.

What Frontline wants Verizon sanctioned for is their failure to comply with the FCC s rules regarding required disclosure of communication with the FCC.

Frontline accused Verizon Wireless of not adequately disclosing the content of its conversation with FCC Chairman Kevin Martin and his staff during a Sept. 17 meeting. Under the FCC’s so-called ex parte rules, companies meeting or communicating with the FCC during an ongoing proceeding are required to disclose a description of those communications to other interested parties.

Being banned from the auction isn t the only reasonable sanction that the FCC could use in this case. Fining the company, requiring full disclosure at this time and disallowing Verizon from future auction filings are all also viable sanctions. Of course, those wouldn t help Frontline nearly as much in gaining an edge over their competition in the auction.

We all know all too well about the gaps in cell phone communication that cause us to lose our connections. At the very least, these gaps are frustrating and in some cases they can be detrimental to a person s ability to access emergency services. TerreStar Networks is working on a $1 billion satellite system designed to fill in those gaps to improve communications and emergency services. The system, which they hope to have up and running next year, will be tested out in Northeastern Vermont, an area chosen for its qualities as a developmental sandbox where applications for rural areas can be widely tested.

Sprint Speeds Up Wireless Broadband - New Ev-DO Rev is faster, smaller and has more storage

Sprint has been a leader in wireless broadband with EVDO cards that bring broadband speeds to mobile devices. They ve announced the upcoming release of the world s smallest EV-DO Rev., the Ovation U727, which carries 4GB of data to provide on-the-go mobile broadband access to any device with a basic Type A USB port. The technology, developed in conjunction with Novatel Wireless, works on the Sprint Mobile Broadband Network to give users speeds of 3.1 Mbps for downloads and 1.8 Mbps for uploads (although we know that the real times are significantly slower than these peak time performance speeds). Nevertheless, this does bring faster speeds to Sprint mobile users who will be able to get the U727 starting next month. Trying to stay in competition with Sprint, Alltel is expanding their EVDO market.

MPAA Fights Piracy with more Lawsuits - Targeting websites, ISPs and users from all sides

In an ongoing effort to fight piracy, the MPAA has filed lawsuits against two different websites which allow users to watch pirated movies. The websites being targeted are ssupload.com and cinematube.net, sites which reportedly obtain pirated copies of films that are still in theaters. The MPAA argues that this does significant damage to the film industry. They claim that the industry lost over $18 billion to piracy in 2005.

We are putting illegal Web operators on notice that they are not above the law and will face serious consequences for their activities,” said John Malcolm, executive VP and director of worldwide anti-piracy operations at the MPAA.

Recent positive developments for the MPAA in other related lawsuits indicate that the MPAA’s legal crackdown could be working in their favor for the time being.
